1. INTRODUCTION
Encriss Technologies LLP (“Encriss”, “Company”, “we”, “our”, or “us”) is committed to protecting privacy, maintaining data security, ensuring responsible use of technology, and safeguarding users interacting with our websites, platforms, applications, APIs, chatbot systems, Artificial Intelligence systems, automation platforms, communication systems, and related services including GMart Automation. This Privacy Policy, Data Protection Policy, and Child Safety Policy describes how Encriss collects, processes, stores, protects, uses, shares, secures, and manages information in connection with the use of the Services.
2. APPLICABILITY
This Policy applies to all users, customers, visitors, enterprise clients, affiliates, partners, vendors, implementation partners, chatbot users, API users, website visitors, and any other persons interacting with Encriss systems, platforms, websites, applications, communication systems, AI systems, or related Services.
3. INFORMATION WE COLLECT
Encriss may collect and process personal information, business information, account information, device information, communication records, customer data, workflow data, AI prompt data, chatbot interaction data, analytics data, cookies, logs, API information, technical information, billing information, support communications, usage information, security information, metadata, and other operational information necessary for providing and improving the Services.
4. CLIENT DATA
The Client retains ownership of Client Data submitted to the Platform. Encriss may access, process, store, host, analyse, secure, retain, transmit, replicate, archive, monitor, maintain, and otherwise handle Client Data for purposes relating to operation, support, analytics, automation workflows, AI systems, integrations, security, compliance, diagnostics, maintenance, performance optimisation, and provision of the Services.
5. PURPOSE OF PROCESSING
Information may be processed for providing Services, account management, support, automation workflows, chatbot services, AI processing, communication services, integrations, analytics, diagnostics, performance monitoring, security, fraud prevention, troubleshooting, maintenance, billing, customer support, service improvements, legal compliance, and operational management.
6. AI SERVICES AND AUTOMATION
Encriss may use Artificial Intelligence systems, Large Language Models (LLM), automation systems, chatbot systems, recommendation systems, analytics systems, and AI-assisted technologies as part of the Services. AI-generated outputs may be probabilistic in nature and may not always be accurate, complete, or reliable.
7. COOKIES AND TRACKING TECHNOLOGIES
Encriss websites, applications, and platforms may use cookies, session identifiers, analytics tools, tracking technologies, authentication systems, telemetry systems, logging systems, and similar technologies for security, authentication, analytics, monitoring, functionality, and service optimisation.
8. THIRD-PARTY SERVICES
Encriss may engage third-party service providers, cloud providers, infrastructure providers, communication providers, payment gateways, Meta / WhatsApp services, AI providers, analytics providers, API providers, telecom providers, hosting providers, monitoring providers, and technology partners for operation and delivery of the Services.
9. DATA SHARING
Information may be shared with authorised service providers, affiliates, infrastructure providers, AI providers, communication providers, payment processors, legal authorities, regulators, subcontractors, security providers, analytics providers, and technology partners where necessary for operation of the Services, legal compliance, security, fraud prevention, enforcement of rights, or protection of Encriss systems and users.
10. DATA SECURITY
Encriss implements commercially reasonable technical, organisational, operational, and administrative safeguards to protect information against unauthorised access, misuse, disclosure, alteration, destruction, or loss. Security measures may include encryption, access controls, authentication systems, monitoring systems, audit logging, firewall protections, cloud security controls, and operational security practices.
11. DATA PROTECTION POLICY
Encriss is committed to implementing reasonable measures to protect information and maintain confidentiality, integrity, and availability of data processed through the Platform and Services.
12. CLIENT RESPONSIBILITIES
The Client shall remain solely responsible for ensuring that all data, communications, customer records, campaigns, workflows, prompts, messages, and information submitted to the Platform comply with Applicable Law, privacy obligations, communication regulations, industry standards, and third-party policies.
13. CROSS-BORDER PROCESSING
Information may be processed, stored, transmitted, backed up, replicated, or hosted across multiple jurisdictions through cloud infrastructure, hosting providers, communication systems, AI systems, or authorised third-party providers used by Encriss.
14. DATA RETENTION
Information and Client Data may be retained for periods necessary for operational requirements, support, legal compliance, security, analytics, backups, audit requirements, dispute resolution, or other legitimate business purposes.
15. DATA EXPORT AND DELETION
Requests relating to access, export, correction, deletion, or retrieval of Client Data may be subject to verification, operational feasibility, contractual obligations, outstanding dues, retention periods, and Applicable Law.
16. CHILD SAFETY POLICY
Encriss is committed to maintaining a safe digital environment for children and minors. The Services are not intended for use by minors or children without appropriate parental or legal supervision and consent where required under Applicable Law.
17. PROHIBITED CONTENT INVOLVING CHILDREN
Users shall not use the Platform, Services, chatbot systems, communication systems, AI systems, APIs, or automation systems for transmitting, storing, generating, promoting, distributing, or facilitating any unlawful, exploitative, abusive, harmful, or inappropriate content involving minors or children. Any suspected violation may result in immediate suspension, termination, reporting to authorities, and legal action.
18. CHILD SAFETY REPORTING
Encriss reserves the right to investigate, monitor, restrict, suspend, terminate, report, or cooperate with law enforcement or regulatory authorities in relation to any suspected unlawful, harmful, exploitative, abusive, unsafe, or inappropriate activities involving minors or children.
19. COMPLIANCE AND LEGAL DISCLOSURES
Encriss may disclose information where required by Applicable Law, regulatory obligations, court orders, governmental requests, investigations, enforcement proceedings, security incidents, fraud prevention efforts, or protection of legal rights and interests.
20. MODIFICATION OF POLICY
Encriss reserves the right to modify, revise, update, or replace this Policy at any time. Updated versions shall become effective upon publication on the applicable website or platform.
